Tennessee Valley Authority Found Liable for Toxic Sludge

A federal judge has ruled that the Tennessee Valley Authority is liable for damage caused by a massive flood of coal ash sludge that inundated Watts Bar Lake, Tenn., and contaminated two nearby rivers in 2008. District Court Judge Thomas Varlan concluded that the TVA is responsible for the damage because of its “negligent implementation and configuration decisions” for two containment dikes, its use of an overloaded coal ash storage facility, and failure to train its employees in applying TVA policies and procedures.
