Dallas Read-End Accident Attorney
What is a Rear-End Impact Collision?
A rear-end accident occurs when one vehicle collides into the back of another.
According to the National Highway Traffic Administration, around 30% of
auto accidents are rear-end collisions. This type of automobile accident
typically happens when one vehicle is stopped at an intersection while
the other approaches too rapidly, either without braking or not having
enough distance to brake in time. Another occasion is when both vehicles
are in motion and the lead car abruptly stops, which then results in a
collision with the car behind.
The following are the common factors in rear-end impact collisions:
- Tailgating or following too closely
- Poor weather/road conditions
- Distracted driving
- Worn brakes or tires
Rear-End Accident Injuries
The most common injury associated with this kind of collision is whiplash.
Whiplash injuries occur when the neck is forced to exceed its normal range
of motion, straining the muscles and ligaments which results in soreness
or tenderness for weeks. If the injury persists beyond that time frame,
it might be an indication of further damage to the neck or spine.
Spine and back injuries are also common in rear-end collisions. These can
result in complete or partial quadriplegia, extensive medical treatment
and physical therapy to restore any function of the limbs. Head injuries
can derive from air bag deployment due to the blunt force of impact caused
by the accident.
Helping Clients to Determine Liability
In order to be eligible for compensation, there must be indisputable evidence
that you were not responsible for the accident and that another party
was. Generally, liability goes to the driver who was behind. However,
there are some occasions when determining liability, such as
multi-vehicle accidents or when a car is backing out of a parking lot.
It’s imperative to collect information related to the accident, such as:
- Names of people involved
- Contact information of all parties
- Descriptions of events
- Witness testimony, if available
