The National Law Journal (2/2, Jones) reported, "The maker of Nutella is the target of a consumer class action filed on Tuesday alleging the company falsely markets its hazelnut spread as healthy for children even though the product is loaded with saturated fat and processed sugar." New Jersey-based Ferrero USA Inc. faces a class of all purchasers of Nutella beginning in January 2000 for false advertising and unfair competition. The suit alleges Nutella "contains 70% saturated fat and processed sugar by weight. Both of these ingredients significantly contribute to America's alarming increases in childhood obesity, which can lead to life-long health problems." It seeks punitive and compensatory damages.
